The adopted rule is in effect and is not open to comment. The proposed amendments to 7.35.2.7, 7.35.2.10, and 7.35.2.24 go to a rule hearing on October 2, 2026, fixed by the notice published August 25 with them. Comment is taken orally at the hearing, in person, by video conference, or by telephone, and in writing until the hearing closes. The official channel

The rule hearing on the proposed amendments to 7.35.2 NMAC and on the proposed 7.35.3 NMAC is Friday, October 2, 2026 at 9:00 AM, in the Harold Runnels Building auditorium, 1190 St. Francis Drive, Santa Fe, fixed by the notice published August 25. The hearing is also held by Microsoft Teams video conference and by telephone; the notice carries the meeting code, the passcode, and the telephone number. Any member of the public may attend and give oral comment there. Written comment goes to Jacob Clark of the department's office of general counsel, by e-mail to jacob.clark@doh.nm.gov or by U.S. postal mail to NMDOH OGC, P.O. Box 26110, 1190 St. Francis Dr., Suite N-4095, Santa Fe, NM 87502-6110, and must be received by the close of the hearing. The department publishes written comments on its website within three days of receipt, and comment given becomes part of the rulemaking record the department must consider. An accommodation request goes to Jacob Clark at (505) 827-2997, with ten days' advance notice requested.

In the rulemaking that produced the adopted rule, the department published a response to public comments after the April 24, 2026 hearing and before adoption; the register on the record page lists it.

What is at issue

Three sections of the adopted rule would change. Each is quoted and noted at the section on The adopted rule.

7Definitions. Twenty-one defined terms would be added, among them certifying clinician, practitioner as rewritten, facilitator, healing center, and New Mexico module; the standalone Guide definition would be struck. These are the terms the proposed program rule, 7.35.3 NMAC, runs on, because it defines nothing of its own. Noted at 7.35.2.7.
10Producer sales. Producers would be permitted to sell psilocybin and psilocybin products to healing centers, as well as to other producers and practitioners. Noted at 7.35.2.10.
24Transportation. Transport would be permitted by designated employees or contractors of a certified healing center, as well as of a permittee or certified practitioner, and the person receiving a shipment, not only a permittee, would verify the chain of custody form. Noted at 7.35.2.24.

The adopted rule, 7.35.2 NMACCurrent state of truth

The adopted rule, published in the New Mexico Register on June 23, 2026 and in effect from that day: twenty-seven sections governing producer and laboratory permits, premises, allowed products, traceability, the five required tests and their action levels, packaging and the product information document, wastage, transportation with a chain of custody, monitoring, and discipline. It supersedes the text proposed on March 24 and heard on April 24, 2026. Proposed amendments to three of its sections were published August 25, 2026 and go to a hearing on October 2; until adopted, the text here stands unamended.
