New Mexico's rule for psilocybin producers and testing laboratories, 7.35.2 NMAC, has been in effect since June 23, 2026. The Department of Health noticed it on March 24, heard it on April 24, and published it as adopted in the New Mexico Register on June 23. On August 25 the department proposed amendments to three of its sections, the definitions, the general producer requirements, and the transportation of psilocybin, and fixed a rule hearing on them for October 2, 2026, the same hearing that takes up the proposed 7.35.3 NMAC. Where things stand

OPENThe department published proposed amendments to 7.35.2.7, 7.35.2.10, and 7.35.2.24 on August 25, with the notice fixing a rule hearing for October 2, 9:00 AM, in the Harold Runnels Building auditorium in Santa Fe, in person, by video conference, and by telephone. The amendments would add twenty-one defined terms, let producers sell to healing centers, and let certified practitioners and healing centers transport psilocybin. Each is noted at the section it changes on The adopted rule. Written comment must reach the department by the close of the hearing; how comment works is on Comment.
SETTLED7.35.2 NMAC is the adopted rule for psilocybin producers and testing laboratories, in effect since June 23, 2026, published that day in the New Mexico Register, Volume XXXVII, Issue 12. Every section carries the history note N, 6/23/2026: nothing in it has been amended. The adopted rule, 7.35.2 NMACCurrent state of truth

The adopted rule, published in the New Mexico Register on June 23, 2026 and in effect from that day: twenty-seven sections governing producer and laboratory permits, premises, allowed products, traceability, the five required tests and their action levels, packaging and the product information document, wastage, transportation with a chain of custody, monitoring, and discipline. It supersedes the text proposed on March 24 and heard on April 24, 2026. Proposed amendments to three of its sections were published August 25, 2026 and go to a hearing on October 2; until adopted, the text here stands unamended.
