Where things stand

Created October 22, 2026. Every claim on this page cites the proposed text, the hearing notice, or a department recording.

New Mexico's rule for the medical psilocybin treatment equity fund, 7.35.4 NMAC, is proposed, not in effect. The Department of Health published it on October 20, 2026 with an amendment to the definitions at 7.35.2.7 NMAC, and fixed a rule hearing on both for November 20, 2026. The fund itself is created by the Medical Psilocybin Act, Section 26-2D-11 NMSA 1978, for treatment of qualified patients who meet income requirements set by department rule; this is that rule. It follows a recommendation the Advisory Board voted on September 11, and departs from it in places. This Part of the site holds the proposed text, what it would require of the people it reaches, the recommendation beside it, and the record.
