The proposed rule

The full text of 7.35.4 NMAC, Treatment Equity Fund, as the department proposed it on October 20, 2026, all twenty sections. It is a proposed rule and is not in effect; every history note reads N, xx/xx/2026, the date left blank until adoption. Where the text departs from the recommendation the Advisory Board voted on September 11, a note sits under the section and the full comparison is on The board recommendation. A note marked New from the department sits under each provision that is in neither the committee's August 18 framework nor the board's September 11 vote and was not found in the captions of the recorded committee and board meetings; the list is at The board recommendation. Line breaks are collapsed for reading; where the extraction stumbles, the linked PDF governs.

The objective of this rule is to establish eligibility, covered medical services , reimbursement, claims submission, payment, recordkeeping and audit requirements for the medical psilocybin treatment equity fund. 7.35.4.7

Definitions

PDF p. 1

The definitions in 7.35.2.7 NMAC apply to this part. [7.35.4.7 NMAC - N, xx/xx/2026]

Note The definitions are imported. This Part defines nothing of its own. The proposed amendment to 7.35.2.7 published the same day would add eleven defined terms to 7.35.2.7 for it: allowable amount, claim, claimant, covered treatment, director, federal poverty guidelines, fund, household, other payer, program manager, and SHARE (amendment pp. 1 to 5). Covered treatment is defined as "a service, psilocybin product, or travel expense eligible for payment under 7.35.4 NMAC" (amendment p. 2). Until adopted, 7.35.2.7 stands as published June 23, 2026, which carries none of these terms.
7.35.4.8

Patient Eligibility

PDF p. 1

A. A qualified patient may be deemed eligible for assistance from the fund if: (1) the patient is currently enrolled in the New Mexico medical psilocybin program; (2) the patient is a resident of New Mexico; (3) the patient’s household income does not exceed 200 percent of the applicable federal poverty guidelines; and (4) sufficient funds are available in the fund and have been appropriated for the requested purpose.

B. Subject to the allowable amounts and limitations in this rule, the fund may cover up to 100 percent of the allowable amount for a qualified patient.

C. Eligibility for assistance does not create entitlement to payment and does not guarantee that funding will be available for all requested treatment.

D. Treatment equity fund eligibility shall be effective from the date of approval, and shall automatically end under the following circumstances: (1) the patient’s enrollment in the medical psilocybin program expires or is suspended, revoked or withdrawn; (2) the patient ceases to be a New Mexico resident; (3) the department finds that the eligibility determination was based on materially inaccurate or fraudulent information; (4) available funding is exhausted or otherwise unavailable; or (5) when 12 months have lapsed from the date of funding approval. [7.35.4.8 NMAC - N, xx/xx/2026]

New from the department Not in the recommendation or the recorded meetings. Subsection D (5): eligibility ends 12 months after funding approval. The committee and the board set no duration.
7.35.4.9

B. An application shall include: (1) the patient’s name and medical psilocybin program identification number; (2) the patient’s residential and mailing addresses; (3) proof of the patient’s New Mexico residency in the form of either: (a) a current and valid New Mexico state-issued identification card or driver’s license; (b) a letter of accommodation from a licensed medical or behavioral health provider attesting that the patient is a resident of New Mexico; or (c) a current and valid identification card from a native American tribe, pueblo, or nation in New Mexico and a utility bill or other documentation that demonstrates residence in New Mexico. [7.35.4.9 NMAC - N, xx/xx/2026]

New from the department Not in the recommendation or the recorded meetings. Subsection B (3): the three forms of residency proof, among them a letter of accommodation from a licensed medical or behavioral health provider, and a tribal identification card with a utility bill. The recommendation required residency and named no proof.
7.35.4.10

Request For Reimbursement

PDF p. 2

A. Before submitting a reimbursement request, the claimant shall make a reasonable and documented effort to obtain payment from all other payers who may be legally responsible for the covered treatment.

B. Requests for reimbursement shall include an attestation that the claimant has pursued reimbursement from other legally liable and potentially liable third parties prior to requesting reimbursement from the treatment equity fund, and was not able to obtain reimbursement. Such third parties may include private insurance, Medicaid, Medicare, and other sources of funding. The request shall include attached proof of denial or ineligibility for reimbursement, which may consist of any of the following: (1) notification of denial; (2) an explanation of benefits; (3) a remittance advice; (4) documentation that the service or product is categorically excluded from coverage; or (5) other documentation accepted by the department.

C. A claim shall disclose payments received or reasonably anticipated from another payer. The amount payable from the fund shall not exceed the allowable amount after deducting all confirmed and anticipated payments and credits from other payers.

D. A claimant is not required to submit a claim to an entity that does not legally cover the service or product when the department has documented that the category of service or product is excluded from that entity’s coverage.

E. If another payer makes payment after the fund has paid a claim, the claimant shall notify the department within 30 calendar days and return the resultant overpayment to the department. [7.35.4.10 NMAC - N, xx/xx/2026]

Open Medicaid named as a payer to pursue first. Subsection B requires an attestation that the claimant pursued reimbursement from third parties that "may include private insurance, Medicaid, Medicare" before billing the fund. At the September 11 board meeting the HCA delegate said that "specifically saying you have to bill Medicaid first might get you into some legal trouble", and the department answered that its attorneys were working on the language. The board voted the intent, not the wording. The comparison.
New from the department Not in the recommendation or the recorded meetings. Subsection E: when another payer pays after the fund has, the claimant notifies the department within 30 calendar days and returns the overpayment.
7.35.4.11

Reimbursement

PDF p. 2

A. The reimbursement payment shall be limited to the lesser of: (1) the claimant’s usual and customary charge; (2) the amount remaining after payment by another payer; or (3) the applicable New Mexico Medicaid or Medicare reimbursement rate.

B. When no directly applicable Medicaid or Medicare rate exists, the department may establish an allowable amount based on the most analogous Medicaid or Medicare service or payment methodology.

C. For a psilocybin product or other covered item for which no analogous Medicaid or Medicare rate exists, the department shall establish a uniform fee schedule based on documented acquisition cost and reasonable program safeguards.

D. A claimant accepting payment from the fund shall accept the allowable amount as payment in full and shall not bill the patient for the difference between the claimant’s charge and the amount paid by the fund.

E. Nothing in this section requires payment for a service or product that is not otherwise covered under this rule. [7.35.4.11 NMAC - N, xx/xx/2026]

New from the department Not in the recommendation or the recorded meetings. Subsection A (1) and (3), and Subsection B: payment is capped at the claimant's usual and customary charge as well as the rate, the rate may be Medicaid's or Medicare's, and where neither applies the department may use the most analogous one. The recommendation capped reimbursement at Medicaid rates.

Open Two sessions per later administration; the board voted three. Open No diagnostic evaluation, and no medication, in the list. Subsection A lists administration sessions and preparatory and integrative sessions; Subsections B and C cover travel. The diagnostic evaluation and the cost of medication, both in the recommendation the committee and the board voted, are not named here. A psilocybin product is reached elsewhere: 7.35.4.11 (C) directs a fee schedule for it and 7.35.4.12 (B)(7) states how it is claimed. The comparison.
