The rule hearing is October 2, 2026, fixed by the notice published August 25 with the revised proposed rules. Comment is taken orally at the hearing, in person, by video conference, or by telephone, and in writing until the hearing closes. The official channel

The rule hearing on 7.35.3 NMAC and the proposed amendments to 7.35.2 NMAC is Friday, October 2, 2026 at 9:00 AM, in the Harold Runnels Building auditorium, 1190 St. Francis Drive, Santa Fe, fixed by the notice published August 25. The hearing is also held by Microsoft Teams video conference and by telephone; the notice carries the meeting code, the passcode, and the telephone number, and a calendar invitation can be requested at the registration address it lists. Any member of the public may attend and give oral comment there. Written comment goes to Jacob Clark of the department's office of general counsel, by e-mail to jacob.clark@doh.nm.gov or by U.S. postal mail to NMDOH OGC, P.O. Box 26110, 1190 St. Francis Dr., Suite N-4095, Santa Fe, NM 87502-6110, and must be received by the close of the hearing. The department publishes written comments on its website within three days of receipt. Comment given becomes part of the rulemaking record the department must consider, and changes can still be made through the hearing, as they were in the producer rulemaking. An accommodation request goes to Jacob Clark at (505) 827-2997, with ten days' advance notice requested. The hearing was first set for August 28 with the July 23 publication, which was set aside.

What is at issue

Four things in the published text are unsettled or contested. Each has a page stating what the record holds.

HOURSThe practicum and didactic hours were deferred to the Training and Education Committee by a 7-0 board vote on July 17. The revised text published August 25 doubles the therapy module to 65 didactic hours with 10 simulated patient hours, an 80-hour total matching the committee's, without the committee's minimums in nine content areas, and keeps the practicum at 100 and 120 hours against the committee's staged 102 and 114. The recommendation, at its August 21 position, is stated in full beside the published text on The committee recommendation.
CS NUMBERThe published text requires a certifying clinician to hold a New Mexico controlled-substance number, at 7.35.3.9 (D)(2) and 7.35.3.8 (B)(3), and the amended definition of certifying clinician carries the number inside it. The department kept the requirement on July 17. The arguments made on the record, on both sides, are on The controlled-substance number.
AT-HOME CAREFor an other approved location, which may be a patient's residence, the published text at 7.35.3.11 (B)(9) requires proof of ownership or a signed, written statement from the property owner acknowledging that persons will be participating in the medical psilocybin program on the premises. A patient who rents cannot be treated at home without the landlord's signature. The provision is noted where it sits, on The published rule.

JUL 17Training hours, didactic hour requirement. Received through the input form. "The 35 hour didactic requirement seems insufficient. I hope there will be more time for a thoughtful discussion and a rationale before the number of didactic hours is set. An official training and education committee intercession work group would be helpful in pulling together all of the different ideas that have been discussed informally. Revised proposed ruleCurrent state of truth

The revised proposed rule, published August 25 with the notice fixing the October 2 hearing, superseding the set-aside July 23 text. Raised the practitioner and facilitator therapy module from 30 didactic hours to 65, at least one third in person, and the simulated patient requirement from 5 hours to 10. Added eleven curriculum topics without per-area hour minimums, a case-presentation evaluation inside the unchanged 100 and 120 practicum hours, a low-risk requirement on the first 20 administration-day hours, and a didactic waiver. Kept the role names certifying clinician and practitioner, defining them in amendments to 7.35.2.7 published the same day.

  • August 13, 2026 This page now owns the input log.
