New Mexico is writing the rules for who may provide medical psilocybin therapy and how they are trained. On July 23 the Department of Health published its proposed rule, and a rule hearing is set for August 28. One of the three items the board set aside is now settled in the text, one was kept by the department, and one was sent to the Training and Education Committee six days before publication. The department published its proposed rule on July 23 and a rule hearing is set for August 28. Two of the three items the board set aside on June 26 are settled. The third, the practicum and didactic hours, was deferred to the Training and Education Committee, and that recommendation is being written now.
The committee's recommendation on these hours needs to reach the department as soon as possible. The rule hearing is August 28, the committee next meets August 21, and the department has said it will take input up to and past the hearing but that the text it publishes is what the hearing runs on.
On July 17 the Advisory Board voted 7-0 to send the practicum and didactic hours, and the 20-hour supervisory question, to the Training and Education Committee. That recommendation is being prepared now and has not yet been delivered to the department.
The rule published on July 23 therefore carries the department’s own figures: 100 practicum hours for facilitators and 120 for practitioners, unchanged, with the shared didactic module raised from 25 hours to 30.
Publishing the full text is what allows the hearing to be scheduled. The department has said input is still wanted and that the hours can still move. Dominic Zurlo, July 17: "we’re happy to talk about adjusting those lengths of time," and that suggestions are needed "sooner rather than later… after the rule gets published or the proposed rule rather gets published and even after the hearing of it."
The department kept the requirement after consulting the Secretary of Health and its attorneys, and it appears in the July 23 rule. The board did not vote to remove it; Chris Peskuski restated his objection that it is an access bottleneck. Both the reciprocity waiver and the New Mexico program waiver deadlines were extended to December 31, 2027 without objection on July 9. The July 23 rule now carries both dates in its text; until publication the draft still showed the older ones. Both remain open to public comment at the August 28 hearing. Settled here means the board and the department have acted, not that the text is final.
